Wrongful Death Due to Negligence
Missouri law recognizes a cause of action for the loss of a loved one due to the negligence of another. If you or a family member have lost someone due to the negligence of another driver or in any serious accident, you may have rights under RSMo. § 537.080. When spouses are left without their loved one's income, or worse, children are unable to grow up with their mother or father, the law allows a jury to hold the negligent party responsible for that loss.
Under the wrongful death statute, the loved one's family cannot collect direct damages for the grief and loss they feel, but they can receive compensation for lost earnings, lost opportunity to continue the relationship, and the loss of companionship.
